UPDATE! – Alabama Fan That Assualted LSU Fan Has Been Indicted

Here's the latest in the continuing saga over the fallout from the Alabama fan teabagging an LSU fan incident. The Alabama fan, Brain Downing, has been indicted by an Orleans Parish grand jury on one count of sexual battery of a male victim, and one count of obscenity, according to the New Orleans' District Attorneys office. His bond was set at $50,000.

From WWLTV... "The indictment against Downing, 32, formally charges him with one count each of sexual battery of a male victim and obscenity.

"While we're obviously disappointed, we remain confident in our defense," Downing's attorney Michael Kennedy said.

A video that went viral on the Internet appeared to show someone in a University of Alabama jacket abusing an unconscious Louisiana State University fan after Alabama beat LSU for the BCS football championship, Jan. 9.

Downing, of Smiths Station, Ala., was later booked on charges of sexual battery and obscenity. He was videotaped Jan. 9 "placing his genitals on an LSU fan's face. The LSU fan appears to be heavily inebriated and practically unconscious," a police statement said.

Kennedy said he hoped the case would be brought to a quick resolution.

"It's my impression that the state is anxious to get this done," Kennedy said. "There is no resolution on the table at this time, but we hope to get something done quickly."

Downing remains "fairly upbeat considering the situation," Kennedy said.

Downing was fired from his job after the video was posted, the attorney said, and has been unable to find another because of charges pending against him."
