A Mississippi attorney who claimed to have choked on a piece of chicken from Popeyes after he did not receive a knife in the drive-thru, has dropped his lawsuit again the restaurant.

Attorney Paul Newton Jr. of Gulfport, Mississippi dropped his lawsuit against the delicious chicken restaurant because "extreme comments" were directed at his family.

Newton said he was only given a spork at the drive-thru instead of a knife, which caused him to use his hands to tear the chicken, which made him choke on it. According to the lawsuit filed, he had to undergo emergency surgery to remove the lodged piece of chicken in his throat. Newton said in a statement:

I continue to believe that the facts demonstrate an unsafe condition to the public that could easily be solved by the responsible parties at very little cost. I am hopeful that my filing of the court proceeding results in such remedial actions. However, due to extreme comments directed to me and my family, I have determined not to pursue this matter further.
